Can my employer wait to pay me vacation pay for two or three pay periods after I took vacation?

I took vacation at the end of September and first week in October. I still haven't been paid because of the "budget" issue. Is this legal?

They can wait the same length of time it would normally take to process a pay check. Usually this is anywhere from one to three weeks after you worked it. You should not skip a paycheck. The vacation check should come in place of your regular paycheck, budget or no budget.

If your normal back after vacation paychecks were given to you, then no, they need to pay your vacation pay. It should have come the same way your other paychecks came. Take this up with your management. Budget issues do not give them a pass to withhold monies owed you.
