  • my son had a disagreement at workand walked out of his job he had been working at for 8 months his employer was contacted and he requested p45 holiday pay owing 6 days uniform he had purchased ( chef whites ) i pod ( restrauntused it to play music via) the employer says i will send it , this is 7 weeks ago , he also states the ipod and clothing is missing ( stolen ) my son also tells me the employer has only once given him a pay slip and no contract in writing what i am asking is how do we apply for p45 how do we apply for holiday pay how do we claim for ipod and clothing ( his insuirance ?) thank you in advance .

  • Answer:

The lack of a P45 can only be enforced by HMRC so he needs to tell his tax office about this issue. The lack of holiday pay, expenses, payslips and contract have to be addressed through an ET. The forms are online, but he can get support from CAB with completion of these forms. Normally, you find the issue a an ET1 is enough to make the employer shift.

Report his employer to the relevant authorities as he is in breach of the rules of employment by not supplying a contract of employment and not giving him a weekly payslip showing how much national insurance and tax he has stopped and paid to the relevant tax offices etc.He could be in big trouble so your son needs to use this to get everything he is owed, his ipod etc.Sounds like a suspect employer to me and he wont want trouble.
