Can an employer withhold pay check after issuing pay stub (electronically)?

  • Hello, I have worked for a contract position through a agency at a company (client for the agency). I gave them a resignation notice and continued for ten day upon their request. They (the agency) had issued me a pay stub electronically (emailed as PDF) after 19 days I have been relieved of the duties (which is on Jun 10, 2011). I usually get my paycheck through mail. But, after issuing the pay stub, they are not sending me the pay check and telling me the HR is finalizing my settlement documents. I have been poking them for my pay check, and now they informed me that the final accounts documents are awaiting a response from government regarding cancellation of their responsibilities towards the EAD (since I'm a non-resident alien working on OPT work authorization for F-1 students). Is it true or/and legal to withhold my pay check after issuing my pay stub. If anyone can answer my question, I have one more important issue to ask.
