My employer refuse to pay for my holiday?

Who can I contact if my employer is not paying the required 1.5x overtime pay, or the required 3 or 4% holiday

  • I work as a security guard for a company here in Toronto, Canada. My employer breaks quite a few rules, for one, they refuse to pay overtime, anything past 44 hours a week is paid as a "bonus" (which is tax free) on your paycheck. Another thing is, the management refuses to pay 3 or 4% holiday pay, which every employer must pay. Which agency can I contact to fix this problem? I am in Canada, so please dont refer me to U.S agencies, thank you.

    Jane's referring to an american agency. In Canada, labour law is a provincial matter. In your case, you'd be looking at contacting the Ontario Ministry of Labour. Their phone number is 416-326-7160. The 4% vacation pay only applies if your employer does not give you a paid vacation of at least 2 weeks duration each year.

Listen to Charles. Contact the MoL. Incidentally, if you've been the beneficiary of any of those overtime 'bonuses', know that they ARE taxable, and failure of the company to deduct taxes does not shield you from the responsibility to pay tax. Unless something very illegal is going on (over and above contravening labour law), they will appear on your T-4, and will cost you come tax time. So you might want to do some simple math and put aside a little to account for that. One more addendum to Charles on vacation: it is 4%, but as he said, is only payable if they do not provide the 2 week vacation. If you leave in less than 1 year, they will owe you the money. At the end of one year, they owe the vacation time. Until that point, they actually owe you nothing.
