When should I receive my contract of employment?

Do I get pay for my holiday wihout contract?

  • About 2 weeks ago I've been dismissed from work for no particular reason. I think my endlessly angry employer had some personal issues with me...But I can't prove anything. The thing is I've never receive any contract. On the interview she mentioned about paid holiday (28days) so I assumed I'm entitle to it with or without contract. But 3 months after when I asked about written contract of employment I've got awaiting answer and was told I'm actually not getting any holiday pay without the contract. And after 2 weeks before I've got any further answer I was fired without any notice for unknown reasons and left the same day. I wasn't the only person treated like that and there is many other people still working there without contract and not getting paid for holidays. Is it legal?

    The fact that you turned up for work, did the work and got paid constitutes a contract in Uk employment law. You are entitled to holiday pay and you need to write to your employer requesting this. If they do not reply, you need to take them to an ET - the forms are online, but people like the CAB will support you.
