How to Get W2s and 1099s from previous years when taxes were never filed?

  • Ok my husband has had like 7 jobs in the past 3 years mostly just worked for a couple for a week or two and did a job here or their as a subcontractor and was 1099 or W2. Since his mail was sent t his old house and mail was never forwardeded he never got the documents. he needs to get copies of these but has not yet filed tax returns for 08 or 09(hint the reason he wants the W2s) and those are the years he needs copies for. He has tried calling employers but since they are little consturcution companies not big corporations they are slacking on calling him back. Can he call the IRS even thought he didnt file taxes yet can they locate them for him via his SS# knowing the employers names? hes trying to get all this crap cought up so he can get taxes filed but cant do so without this info. Any ideas on how he can get these? Thanks for the help :)

    Just have HIM call IRS at 1-800-829-8374 and request his w2/1099 information(Wage and Income Transcripts) for free. IRS will mail them to him and also give him a "File by date". Or HE can visit the local IRS office in his city to obtain the w2/1099 (Wage and Income Transcripts) for free. (IRS will not give you any information or mail you any information for him). good luck

Go to IRS.GOV and follow the thread to obtain from the IRS a listing of W-2 forms and 1099s for the year in question. Whatever has been reported to them can be provided to you for preparing your return. Ask for 07, 08 and 09. While you are there get a free Pub 17 so you can read up on how to best do your returns. On the same site you can also download the forms necessary to fill out and file your returns.

Sounds like maybe his employers weren't legit either! Go ahead and file 2009 with whatever paper work available for that year only! You must not try to file 3 years at one time. If there is any missing w-2s or 1099s - from previous years the irs will make your husband aware of the them. (if records exist at all and were sent per the law - the irs has the copies)

I wish I knew exactly what to do. But I think you are on the right track. Let the IRS know that you are activlely trying to get these documents. Also, keep pestering the employers. Its the law that they provide that stuff to you. From now on, make sure you always keep your tax stuff. You'll need that if you want to apply for any kind of home or auto loan. Best of luck...

they may be small construction companies but they have the same requirements as anyone else who pays wages to employees, and they maintain employee records for no less than 4 yrs(REQUIRED!) paying by 1099 is only required if the one performing the service was paid $600 or more and anything other than that the person should be keeping his own records to make sure he correctly reports his income and if he moved, he absolutely should have notified the post office of his forwarding address to be sure his mail was sent on to him sounds like a lot of excuses for shirking one's responsibilities, when all else fails, check bank deposits and hopefully reconstruct his income as best he can, if it doesn't agree with what IRS has reported to them, they will let him know
