Can I file for unemployment if I was wrongly fired?

Can you file for unemployment benefit if you was fired from your job and also if was fired within your 90 day?

  • Answer:

In general the 90 days or whatever the "base" period in your state is would disqualify you from Unemployment benefits. before you even get to the circumstances of your termination of employment. I have known some really lazy people in the boom times pre 2007 who would purposely slack off after the "base period" in order to get fired and get unemployment benefits. The firing part really depends on the state and why you were fired.

Yes you can. Anyone that tells you cant doesnt know what they are talking about. The employer must meet a burden to prove that you were discharged for misconduct in order for you to be disqualified. Anything else and you can be qualified. Some states also can qualify you for benefits and not charge the employer if they show you were on a valid 90 days period upon hire. What that means its a win win for both sides.
