How to install basement fire blocking?

What are my rights with neighbour blocking my widow?

  • I live in a basement flat, and my bedroom window looks into my neighbours garden. The window is split into two ~ a medium and small window, which is also frosted so I can't see a lot anyway. The neighbours in question, are claiming, that by law, I am not allowed (ever) to open my widow. To assure this, they have placed a water butt right outside to restrict me from opening it, and they also put things like tall plants on the window sill. Does anyone know my rights? Surely they are blocking a fire exit, plus, the widow sill attached to my window must surely be mine. The only other window on their side is the bathroom window, which has bars across. No chance of getting out that way either. Any advice, much appreciated.

    I will assume from the way you spelled neighbor that you are not in the US. Here, in Ohio, it is against the law to block potential egress from a basement, especially in rental property. I would be calling the fire marshal.

talk to your landlord, if they are on a different property they can't block the window if they are another tenant and neither of you own the property, you have to talk to the landlord to mediate

Yes, they are obstructing the fire exit. Tell them this and get them to remove the obstructions. If they don't contact your building supervisor and complain.

UK building regs state that ground floor/basement windows should not open outwards onto a footpath, regardless of whether the footpath is shared or entirely in your own garden. If this is the case then they have a point, and your windows may require to be replaced. You are right with regards a fire escape route, but again if the windows met the regs the would open inward and this would alleviate the problem. Regardless of whether the windows open in or not if the window is obstructed, you have no ready means of escape, even if you have to break the window you won't get out. If you rent your accommodation privately, ask the landlord to take this up with your neighbours. If the council owns your property, get in touch with your area housing officer. If you own your property you would be best to consult a lawyer to resolve this for you but this may turn out to be expensive. With regards them placing items on your window sill, I would put it formally in writing to them that they should cease this as they have no rights to do so.

It is illegal not to have a window to get out of for an emergency, or by law they're not supposed to rent the flat. Call the nearest or local Landlord Tenant Law, and get the ball rolling. Good Luck

They are definitely in the wrong. You need to contact first a landlord then go further if it is nt taken care of.

You are covered by an old Law known as Right to light. if they are blocking your light they are commiting an offence which your Council should be able to take action on. Contact Dept. of Enviroment. If you can't open your window, you are deprived of fresh air. tell them , or write to them, you will take the matter further if they continue to block your light. Do It, don't let them walk over you.

yea they cant tell you that you are not allowed to open your window there should be no reason you cant the window sill is yours if its on your window i would open the window and knock their things down i wouldnt care and when they said something i would have told them their things should not have been on my window sill just saying now i dont know if theres anything legal you can do about it but they cannot block your window just because they want to

It is your window to your place right.They have no right to tell you you cannot open it.It would be like saying they cannot open theirs.Are these people for real.Just move their stuff over to the side and politely advise them you can open Your window if you like.

Either go or Telephone Your local Council and if possible take Photographs. Have you bought the Property or do you Rent ? Also are your Neighbours Tenants or Owners? If you own yours look on your Papers and see if there is a clause stating what your Neighbours are saying. They are breaking the Law by putting Obstacles outside a Fire Door anyway and you could go into your Local Fire Station who would do something about that I am sure. If you are Renting ,why don't you mention what is happening to your Landlord too because the Fire Brigade would be after him/her too. Hope you get it sorted.
