Can i apply for OCI or PIO?

OCI or PIO for a child having British citizenship?

  • My baby is born in the UK and since I am now settled in the UK (holding an Indefinite Leave to Remain on an Indian passport), she is eligible for a British Citizenship. With respect to her Indian origin, which application should be made to the Indian High Commission for her, after she gets her British passport? Should it be an OCI or a PIO?

  • Answer:

If she is eligible for a British passport you should apply for the OCI card. It costs £165.00 and grants a life-time entry to India with a U-visa affixed to her British passport. The PIO card is £110.00 for children and £215.00 for adults, but it is subject to renewal every 15 years. http://india.gov.in/outerwin.php?id=http://hcilondon.in/ .. I for purpose have answered "If she is eligible" since I am not sure whether you were supposed to have hold ILR already at the time of her birth to make her a British citizen. Should that be the case you will need to get her an Indian passport and apply for a U.K. dependent visa at Home Office.

India does not have dual citizenship. You have to choose if you want yourself and your child British Citizenship. Or Indian citizenship. If you live in the UK it would be very foolish for you to apply for Indian citizenship. That means you loose your rights in Britain. So If I was you I would forget the link with India and just apply for British Citizenship for your child and yourself. Plus this will save you time and money in the future. Sorry you can not have it all.
