How To Answer Census Questions?

What questions do I legally have to answer on the 2010 U.S. Census?

  • I think that some of these questions are an invasion of privacy. What do I legally have to answer? What is my Constitutional right pertaining the matter? What are the consequences if I don't answer all the questions? Thank you.

  • Answer:

On March 28, 2000, US District Judge Melinda Harmon has granted a temporary restraining order against prosecution of any American who chooses not to answer questions other than the number of people living at their address. So at this point in time you are fully within your legal rights to refuse to answer any question except for the number of people in your home. You do not have to give your name, your ethnicity, your gender, your sexual orientation, or even whether or not you are a legal resident or citizen, or even whether you legally reside at the address. Our advice to you, should a census taker actually come to your door, is to inform them that asking any other question other than the number of people in the home may be grounds for personal contempt of court, citing Judge Harmon's ruling, and that if they persist they may be subject to fines and imprisonment. Also inform a census taker that they are trespassing upon your property and must leave immediately or face arrest. They have no inherent right to be on your property, even though they are from the government.

You MUST answer how many people live in your household... that's it. They ask about 10 questions total, but this is the only one you must answer.

HERE is a quote: "Census Law and Fines The following section of the United States Code requires that people fill out their U.S. Census forms and provides a $100 penalty for not answering the Census and up to $500 for giving false information. 13 USC Sec. 221 TITLE 13 - CENSUS CHAPTER 7 - OFFENSES AND PENALTIES SUBCHAPTER II - OTHER PERSONS Sec. 221. Refusal or neglect to answer questions; false answers (a) Whoever, being over eighteen years of age, refuses or willfully neglects, when requested by the Secretary, or by any other authorized officer or employee of the Department of Commerce or bureau or agency thereof acting under the instructions of the Secretary or authorized officer, to answer, to the best of his knowledge, any of the questions on any schedule submitted to him in connection with any census or survey provided for by subchapters I, II, IV, and V of chapter 5 of this title, applying to himself or to the family to which he belongs or is related, or to the farm or farms of which he or his family is the occupant, shall be fined not more than $100. (b) Whoever, when answering questions described in subsection (a) of this section, and under the conditions or circumstances described in such subsection, willfully gives any answer that is false, shall be fined not more than $500." Coincidentally enough, I was just discussing this with a neighbor when I was out at the street picking up my mail. In essence, you get a slap on the wrist at worst IF they choose to prosecute. If you simply ignore the forms, there really is not much they are really going to do about your failure to comply, though in a technical sense you ARE in violation of the law and could end up in court. It simply isn't practical to take the people to court who just toss the forms into the circular file. You have nothing to lose by answering the questions. Your name and other identifying information is separated from the data you provide, so why NOT answer to the best of your ability? It isn't like there are going to be stormtroopers pounding on your door in the middle of the night because of an answer you provided, or are you REALLY that paranoid?

You must answer all of the questions accurately. Failure to answer any or all of the questions is punishable by a $100 fine. Answering any or all of the questions incorrectly is punishable by a $500 fine. That's it.

All of them. If you don't fill them out, you will be contacted, by phone or in person, by the Census Bureau. According to United States Code, Title 13 (Census), Chapter 7 (Offenses and Penalties), SubChapter II, if you're over 18 and refuse to answer all or part of the Census, you can be fined up to $100. If you give false answers, you're subject to a fine of up to $500.

I was filling mine out earlier today...and I thought, "Why can't I just say how many people are here? This seems like an invasion of privacy!" But then I realized that the IRS has all my information anyway! I would say that if you file taxes, fill the census out. I would also say "Hey, how ya doin?!"

Legally you don't have to answer any of them. But if you do answer them...you need to tell the truth.
