In January i am made redundant from job and asked them that i cannot use the gym now. When i asked the agent of customer serivce to freeze it he said yes (which i was told that they can freeze the gym membership and then told me that there is nominal fees of £7.45 charge and out of no option i agreed. Now in April they charged me £ 41.00 pounds and when i asked they told me that they freezed the memebership for one month. I asked them to send me an recorded conversation file and the agent asked me to send an £10 cheque to send the recordeconversatio. I explained to him that i don'thave job now so i cannot pay and i want to cancel the membership he said that i have to pay half the membership fees of 1 year which is £ 180.00 pounds to get rid of membership(since it was in the agreed contrat which i signed blindly) and that too he says that it's an offer that's why its less fees. So could anyone please advice me who to seek to take legal advice on this famous fitness club.

You entered into a contract of your own free will so what makes you think you can now take any legal action against them? I joined a gym last year knowing that with the looming recession, it was quite possible that I would lose my job, so I got them to add a clause into the contract stating that I could cancel my membership with no charge if I lost my job (not cancel for any other reason though). They agreed to this, and then when I did lose my job, they did allow me to cancel the contract with no penalty. However, in your case, you didn't have this clause and you want to break your contract anyway, so why should you expect not to pay? Get over yourself.

For everyone: Gym membership contracts are written in the gym's favor, not yours. The gym could close down and you'd have no recourse to collect any refund because they went broke. But if you go broke, you are obligated to fulfill your end of the contract. You generally have no way out. If you can't abide by the contract, either get them to make changes or don't accept it. Re-read your contract. Is there any statements that says your membership can be frozen and for how long? Is there a termination clause that states 50% of the annual membership is the termination fee?

God they are so bad!!! wat u need to do honey is check the contract before you sign up for it, coz u can sign away an 18 months contract and not think of cancellation charges! so bad. Go to a lawyer and go to citizens advice bureau for more help! lol take care honey! :)

If you have signed up to a years contract there's not much you can do. Have they broken any terms of the contract at all? If so, use that as an excuse to terminate the contract. My advice is to be careful and get some advice from Citizens Advice. I was made redundant and physically couldn't pay anything so I had to cancel the direct debit. I tried everything to get out of it but in the end they referred me to a debt collection company who I'm still paying to this day!!! If they're offering you a 50% reduction to get out of your contract then I personally would grab it and run! Or ask to freeze your contract for 3 months which will allow you to find employment and then you will resume your membership. x
