What happens if the driver in an accident has no insurance but the other driver does?

  • My mom got in a car accident with another driver at night My mom has insurance and she asked the other driver for her insurance information. The driver did not give my mom her insurance information for the driver had no insurance whatsoever. So instead, my mom and the driver exchanged cell phone numbers for both can keep in contact and the drivers left My mom did not contact the police or wrote down the license plates for she was scared that both drivers in the car, came out made and cursed at my mom and made her feel scared and my mom thought she was going to get hit or worse; be beaten. Also, my mom contacted her insurance company about the accident the next day and gave them a portion of information of the accident. two weeks later... the driver with no insurance is threatening my mom by saying that she is going to call the police for a "hit and run" when we are not running away. After all, my mom was the one to ask her nicely for her insurance and the driver snapped and continued saying F*** Y**! at my mom.and in addition she is now saying that she does have "insurance". but if she did .Why didn't she gave her insurance information in the first place? and why wont she give us her license plates when we ask her for it on the phone? This has been 2 weeks of the car accident case between my mom and the driver. I am getting tired of this!!!!! here are some more information of the driver: -african American - female -No insurance -Rude behavior please answer, thanks in advance

    Your mom needs to make a report with her own insurance company and if the woman calls again refer her to the insurance. The insurance company will complete an investigation and handle the claim accordingly. If your mom's policy includes collision coverage her insurance will pay for the damage to her car less the amount of her collision deductible. If you have any other questions the claims adjuster can answer them for you. Good luck

Only one person can be driving a car at a time. Mom needs to file a police report, and turn this in to HER insurance company, and let THEM handle it. Period. End of story. Mom has insurance. Mom SHOULD have written down the license plate. Race and manners are completely irrelevant.

Do not answer the phone or speak to the other driver. That is what your mom pays your insurance company to do. Your mom's insurance will talk to the other driver. As far as the other driver making threats just igore them and do not answer the phone when she calls. If your mom has uninsured motorist insurance on her auto insurance your mom's insurance will fix your mom's car. Bottom line: do not talk to the other driver. Let your mom's auto insurance company handle the other party. That is what you pay your insurance company to do.

Without a police report your insurance company will wash their hands clean of any involvement. Besides getting in an accidents, the fear of the other driver should have been a good reason to call the cops. Plus if they are smart, won't call for a hit and run because they were operating a vehicle with no insurance. Good luck!
