How legal is it for a debt collector to call a friend?

  • I did some reading online but I need a little more information... My old roomate (from over two years ago) sent me an email saying that a chinese man keeps calling her for me... He says that I put her name down on something... What I don't know!!! She said that it's a loan or something... From what I gather online the debt collector is not to say they are a collector and are only to say their name. Well, she knew that it was a debt collector... and said she thinks it might be a loan? Well-- I dont have any loans. I went through ALL my voicemails and had no message from a chinese man. The problem with the debt collectors is that if I cant pick up (they ALWAYS call when I'm at work or in class)... that when they leave a voice mail, it's an automated person, and their entire message is cut off and all I get is the end... but it's not even enough to gather a number or what it's reffering to. My other problem is that all my bills are being sent to my fathers house.... He always forgets to tell me, even when I ask... And I wont get the letters til 3 months later. I've asked the collectors to mail me at my address but they never do.

    1. They cannot discuss details of the debt, but saying they are a debt collector is not illegal. 2. Change your address with the post office, then your mail will be forwarded. 3. You do not "ask" collectors to mail you at another address, you send a written change of address order to them. Good luck

Go to the post office and file a change of address card from your father's address to your current address. They can call your friends.

You should speak with an attorney! They can call; they cannot tell the "friend" what the call is about... They can leave a return number, they cannot continue to call if your "friend" request clearly and slowly to Cease and Desist... It would be ideal for you to set up a PO Box and contact the creditors to give them your updated number. Clearly tell the creditor of you intent so that they can proceed with writing off of the debt or taking you to court.

Ambivalence

Collectors can call family and friends to track you down. They cannot say they are debt collectors or discuss and particulars. They pretty much can only ask your whereabouts and leave their name and number. Your friend may have made assumptions about the call and the collector may not have given any actual info. You definitely need to change your address so you get your bills.

Networking through your friends and family to find out things about you is called "skip tracing". They hunt down where you live, they would love to find out where you work among other things. Google that term and you'll see how slimy collectors can be in their methods. Of course, that's not to say that the people that are debtors are angels about it either.

They can't say they are a debt collector. They can say it's about a personal business manner: Yes they can call your friends, family, neighbors, places of employment to try to find you.

if i were u, i'd speak with an attorney! if some 1 called ME & didn't say what they wanted I'd IMMEDI8LY hang up. this is how u set BOUNDARIES!!! hanging up sends a strong message. additionally, yer friend can consider putting the ph OFF the hook during hrs they're @ work
