Who applies in car insurance, the owner or the driver?

In Colorado, if you get hit by a drunk driver and the owner of the car isnt driving, who's insurance pays?

  • The owner of the car was in the passenger seat but the driver was drunk. Trying to find out who pays, the owner's insurance or the actual driver's?

    Well since the car hit you and the owner wasent there, the owner still has to pay insurance.
