My friend went to a tattoo place.... legal advice?
-
my friend went to a tattoo and piercing place to get her hips pierce a month ago. she cleaned them everyday. they got very very infected. you could tell from the day after she got them there was something wrong. she is 16. they dont id at the place we went to, they make you sign this contract. she said she was 18. when she called the day before though, they claimed you dont have to be any certain age to get your hips pierced. a month later, yesterday, she went to get them checked out at another tattoo place. they said they were thouroughly infected and she needs to take them out immediately. the place she went to to get them pierced used the wrong piercing, and the guy at the other tattoo place said he knew the guy who pierced her and he was just the cashier, and he didnt have a liscense. Hip piercings are very tricky and different than other piercings. the contract she signed said nothing about getting pierced by someone unprofessional. also, my friend has proof this happened. she took a video. legal advice?

Answer:
"Legal advice"? Your dumb friend lied. She needs to get medical attention for the infection and, hopefully, learn a lesson from this.

The first thing your friend should do is to get medical treatment. After that, she and her parents can think about suing. She should keep her video and any paperwork she has in a safe place. When she gets medical treatment, she and her parents could talk with someone at the hospital about reporting this incident to the local health department. Someone needs to do this so something similar doesn't happen to someone else.
Regardless if your friend lied about her age, the person who did it was not licensed, for any piercing there is ALWAYS a danger of infection and when that happens MUST remover the piercing period. I guarantee that the contract she signed warned of infection and complications. Granted since she was 16 and not 18 and they did not verify her age could be a problem. http://answers.yahoo.com/question/index?qid=20101106105518AAuhgFN There could be other reasons as shown in this question from a professional piercer. (answer #3) As for suing, only a lawyer could tell if she would win/lose.
