Unemployment benefits for irresponsible employee?
-
I am an employer, recently I became fed up with one of my employees not showing up, she has worked for us for about 6 months , and to date has had 10 unexcused absences and 3 excused absences, none of them we paid her for since she just started this year. This last unexcused absence was it for us, she was just too unreliable, the day after her last unexcused absence she just texted me to let me know she was not going to make that day either, I decided not to text her back, she came in late anyway but since she had texted me she was not coming I decided to send her home and told her I would call her once I had more work for her that I did not have time to deal with her schedule, so technically I did not "fire" her but I have not called her since, and of course she does not care to call me. I have learned from another employee she is planning to get unemployment benefits, which really baffles me since she has conducted herself so unprofessionally, aside from the absences, she has had 2 write ups, and a few poor services, it is all logged in our software. So even though she did not sign anything as far as write ups, negative services or whatever, will she still be able to get benefits, the only thing she did sign was our office policy. I don't know if I could use the above to keep her from getting benefits someone like her does not deserve. Please advise, thank you!

Answer:
If you had fired her for unsatisfactory attendance she would not be eligible for unemployment, but since you in fact just quit giving her a schedule she was basically "laid off" and now is eligible. It appears that you did not do your job properly and will have to pay for it.

i think i would have a tendency to put her back on the schedule for one week. you know she is going to pull "something" that you can use as a legal way of firing her. even tho she may think you laid her off - does she have anything from you in writing that says she no longer works for you - i believe that the unemployment offices will require a statement from the employer saying the person applying has been laid off.
If she files for unemployment, the unemployment people will call you and ask why she was terminated (or not given hours), or might send you a form to fill out asking that, or both. Tell them she was terminated for her very poor attendance, and give the details. Benefits will likely be denied. If they're approved, I'd appeal given how unreliable she was.
