What does a "clerk of court" do?

Court Clerk Under charged me, am I responsible?

  • I was charged with 720.00 worth of fees and told I needed to pay at the court clerk. I gave the clerk my debit card and signed off without looking at the receipt. Later I checked my bank account online and was shocked, the clerk charged me $7.20 instead of 720.00. Am I responsible for fixing this error or fore the rest of the fine?

    Of course you are. You are responsible for paying the full amount of the fees. When the account is audited (and it WILL be audited), the mistake will be caught and they will come after you. If you are very lucky, they will only come after you for the remaining balance. They could very easily go after you for the late fees, too, because they would assume there was no way that you shouldn't have picked up on the fact that you hadn't paid anything close to the full amount. (So you aren't going to be able to claim this was an honest oversight on your part.) Do the right thing and it will never come back and bite you.

If the Judge ordered you to pay $720, then that is what you must pay. The Clerk's mistake does not change a Judge's decision.

Just pretend you didn't see it. But if they find out, they have the right to charge you. If you don't receive any notice after a year I'd say you're pretty safe.

Thier mistake, but your problem. You are still responsible for the difference. If caught you could receive additional fees. Your best thing to do is to go back and let them know.

Actually, they won't 'come after you'. They will send a 'correction' to your bank on the debit card. One day soon your account will be 'missing' the $712.80 you already authorized. I guarantee they have a piece of paper with you signature and the CORRECT amount of the fine.
