What are the rights of an employee?

What are my rights as a customer when I was rudely asked a private question by an employee of McDonald's?

  • At a recent visit to McDonald's in NC, an employee in the drive through asked me if my children are mixed, my children are in no way mixed nor do they even look mixed, they don't even have a tan, they are as white as white comes. I felt that this was no right of the employee and rudely responded with no, drove off to a nearby parking lot to vent and cool off and then called the store and spoke to the manager, and then I called corporate after arriving home, I really feel like McDonald's is not going to do anything and I want to know what my rights are to get something done, because no customer should have to worry about going to McDonald's as a customer and have to worry about being asked private information. I am not looking for a lawsuit but to just get this resolved and some type of assurance that this wont happen to me again or anyone else. Although I should have requested a full refund for my order being that I couldn't even eat my snack wraps because the question upset me that much.

It has probably already been taken care of. Either that employee has been reprimanded and counseled on what to say and not say, or they have been fired. So chill out and forgive them. The question was probably spoken out of curiosity and not meanness.

What did they say they would do about it? You should follow up and ask what they did about it. You really don't have a lawsuit here. The only damage is that you couldn't eat.

You did everything you can do under the circumstances. He probably denied the situation occurred or that he would ever ask a customer a question like that. All you have is hearsay...which goes nowhere. Without proof or witnesses, there is not much you or McDonald's can do, especially if this is the first complaint. I have great sympathy for you and understand how upset you must be, however, you did the right thing by notifying management and corporate that a situation did exist and now they will watch.and monitor. They hate this as much as you. I probably would not return to that McDonald's, someone with this low a character will not go very far in the employment world, or in life for that matter. Best to you and yours.

First of all, I completely agree this was a completely inappropriate question. You have every right to be upset with the situation, McDonald's, and that particular location. If I were you, I'd want the person fired. That said, you don't really have any legal recourse here: no crime was committed. If you were in some way harmed via tort (a non-criminal wrongdoing), there are no calculable damages from the facts you've presented. You're talking about what is called Negligent Infliction of Emotional Distress (or possibly Intentional Infliction of Emotional Distress). Whether NIED or IIED, you need to show the emotional distress caused by the McD's employee was so bad you suffered physically. You have to show medical treatment (or even psychological treatment) to sustain your burden of proof. This would also show your damages, by the way. People stay exceptionally stupid things all the time, unfortunately. Stupidity isn't actionable in most cases.

Oh your making a big deal out of nothing I have a step daughter who is not of my culture [white] once in a hotel I was walking her to our room an employee asked me ''do you know this child?'' yes she is my daughter that evening we were told the management would like to give you and your family a free dinner ''no not needed I appreciate the man was just protecting the child he had never seen me in his life'' on check out there was no charge for the room
