Is kissing someone illegal if you have HIV?

  • I know having sexual activity is without telling someone you have hiv is illegal, but what about kissing someone? If i meet someone at a party or club, can we make out or do I have to tell them I have HIV befoe? is kissing someone w/o telling your status illegal as well?

    It is not illegal because you cannot spread HIV through saliva. However, if you have bleeding gums, then there is a small chance of spreading the virus. The problem with this situation is that if you are making out with someone and they want to go farther, you have to reveal your HIV status. Most people are uneducated about what the virus is and how it can be spread, so you have created an atmosphere of fear and anger by allowing a stranger to make out with you and THEN saying that you are HIV+. Most people will not appreciate you saying nothing while you are making out with them. Sounds like a good way to have someone beat the sh*t out of you. If you live in a large city, there is probably an HIV support group you could join to meet people. In that type of situation, you HIV status will not be much of an issue.

I really cant answer that but I would think you would have enough decency to not do something that would put people at risk. Find someone who shares the same problem you have and live out your life with them do not go around putting people at risk, it's irresponsible and just down right wrong.

It is not illegal to kiss someone without informing him/her that you have HIV/AIDS, but it would probably be doing both yourself and that person a disservice not to speak up at a point. What if things start getting heavier than kissing? If you have a cold sore, canker sore, or cut in your mouth that is bleeding, you can transmit the virus through that perforation, and you need to be mindful of that. I'm not saying be paranoid, but think about how you would feel if you transmitted the virus, even unknowingly, even if it's obviously unintentionally.
