Is kissing someone against their will illegal?

I have already had cold sores, will kissing someone with one cause me to have an outbreak?

• So my boyfriend has a cold sore. I understand that this Herpes virus is something you can get and you have for the rest of your life, it is incurable. My question is, even if I already have this virus, will kissing him cause a physical sore on me again, or does kissing someone with a cold sore JUST cause the initial infection? I just wanna be sure that if I kiss him, I wont get a new sore of my own and have to wait even longer to kiss him :(
