How much does a cable/satellite provider have to pay?

After accident settlement, can medical provider expect me to pay the amount above his negotiated rate?

  • I've settled with insurance co. Bills were paid by 2 insurance co.: Primary (auto) paid full amt billed, until benefits exhausted. Provider was a contracted provider with secondary (regular health) insurance, but expects payment for amount above negotiated rate. It doesn't sound right to me that the provider can ask for excess amount billed.

  • Answer:

When you asked for service, did you sign the paperwork agreeing to pay any remaining amounts? If yes, you are stuck.

Have you TALKED to them? Did they TELL you that they are allowed to bill you above the negotiated rate? Call the secondary insurer. Ask if this provider is ALLOWED by contract, to bill you above the negotiated rate, or if they are balance billing. Ask the secondary for an explanation of benefits, which has everything repriced to the negotiated rate. Then, go back to the provider, and explain that this is balance billing . . . and you think it's illegal, and ask them to respond to you IN WRITING.

Technically no, since if not for the auto accident and they would have billed your health insurance, your negotiated rate with your health insurance. It sounds like since they know you got a settlement that they want a "piece of the pie" you received. The provider has a contract with this provider and has to oblige by it. There is only 1 other explanation and that is if you have a deductible/co-pay and/or co-insurance that your health insurance did not pay and they would be owed. But even if that was the case, say they billed you $1,000, contract rate is $650, you have a 80% co-insurance, then you would owe 20% of $650 or $130. You need to send copy of your EOB to them showing the amount owed for the medical service you received and if it shows under what patient owes is "0", then explain that you owe them nothing. good luck
