Is free street parking available in most German cities?

Parking Citation error?

  • I parked my car in front of a home to ho hike up a mountain. This parking spot had those white square marks saying you can park in that area, but the owner of the home had a sign on their trash can that said no parking. I figured that would be the cities decision, so I parked their anyways. Of course, I got a parking citation which said I was parked in a red zone/ no parking. I'm not sure if this was okay or not so I took pictures of the area I was in to show the city looked okay with where I was parking, but the owner of the home was'nt. Is it okay for that person to put up a no parking sign and people have to obey it? It wasnt on their property, it was on a public street. Thanks

  • Answer:

In order to be enforceable the zones must be established by the city or town. A "Red Zone" curb must be painted red. A No-Parking sign must be permanently posted. A homeowner cannot just arbitrarily invent their own no-parking zone. Take it to court and talk to the judge.

No, people cannot put their own "No Parking" signs up. It has to be placed by the city. If the owner of the property took it off some sign and placed it in front of his house then you should tell that to the judge. If this was the case then maybe the cop made a mistake and you made a good choice by taking pictures to have proof. "No Parking" signs are placed on poles not on garbage cans so the owner illegally placed it there because it is a public street. The only way that those signs are not on poles is when construction is going on but then usually (at least where I live) they're on trees. The only way that people can have their own private parking spots is when someone is handicapped but you still have to go through the city and the city will put it up for them.
