How to discharge debt?

After bankruptcy discharge, how do you handle some of the debt that got missed in the filing?

  • To clarify, a credit card company took a chance on me. They gave me a $300 credit line before my bankruptcy went through. I had severe financial difficulty with car trouble, college age kids and I am very far behind on payments with this CC company that gave me a shot at rebuilding my credit. I want to do the right thing. How does this further damage my already BAD credit?

    Some debts are left off the filing if you are current on those payments. Usually you and the attorney can pick the debts. They are usually the house, car, department store credit card or a Visa or Mastercard you are current on. Sometimes if the card is open, but no balance, the credit card company may close the account anyway. If you want to keep the card, which I recommend you do, as it is difficult right after bankruptcy to get any kind of card. You may want to call the card company and see if you can work out a payment plan. The payment amounts on $300 would be extremely small. Contact your attorney that did your bankruptcy and he can do an "addendum" to it. At least it used to be like that but I know bankruptcy laws have changed.
