What is the most interesting branch of law?

What are your top two or three "violations" of the intent or 'spirit of the law' with regards to the US Constitution, made by the US Federal Executive branch?

  • This question branches off from a discussion in... I see this as a related/similar question also: These acts must have bypassed traditional legislative branch AND/OR judicial branch processes.  Generally not something that was a poor decision or a "mistake" (eg, Clinton/Lewinsky), something Constitutionally fundamental.

  • Answer:

A violation of the intention of the law. That is an interesting concept to me. Since the constitutuon was written 230 years ago, they had no idea how technology would develop. The biggest violations of the intention of the law would be uses of technology that would have been unimaginable back then. The one that comes to my mind is the third amendment. The intention of that is surveilance. Plain and simple. The government cannot put a devise in your home to record your personal life. 250 years ago the british soldier with the ability to write was the most high tech devise known. Now its a little different. The legal wording says soldiers though.
