How do I get a debt collector off my back for my Exs debt?

  • I recently got a call from a debt collector from my ex wifes school loans, we have been divorced for 8 years, they say my name was used as a reference,should I be worried?

A reference means that she put you down as someone who can vouch for her. At that time I am sure you could. Now probably not. Since you are not a co signer you will not be responsible for the debt. If you know where she is at, give them the information. Then tell them to stop calling. If you honestly don't tell them you don't and demand they stop calling. To be completely sure send them a cease and desist letter. They must by law stop contacting you

If they say they are calling to collect on a debt or providing information that your ex owes a debt inform them that they are violating the Fair Debt Collection Practices Act. "COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector." You are a third party since you are not married to her anymore & not a co-signer on the loans.
