What are the rights of an employee?

I have heard that my employee has either Hep. B or Aids. What are my rights to protect my other employee?

  • Answer:

This is really something you should either talk to a lawyer or an HR professional about. It is not only a matter of legal or illegal, it is a matter of ethics and personal privacy. I really don't think a public forum where anyone can answer a question of this magnitude can be trusted whole heartedly. I really think it is in your best interest to consult with professionals who have experience in this situation before moving forward. It will protect you and your employee.

I doubt if it's AIDS. unless he's talking about having several different auto immune diseases and those aren't contagious. In any event if he's able to do his job and has been working there any amount of time I'm sure his doctor knows and would inform him of what he should take precautions with.If your employee's are aware of the fact's then he must have opened up the door to questions at some point or no one would know.Next time he opens the door walk through, otherwise keep his confidential information along.I'm sure you wouldn't go up to just any other employer and ask there personal health issues.

The only thing you can do that is "humane" is to maintain a very high level of cleanliness! Have hand sanitizers available everywhere. Hot water and soap are most important and signs saying to wash carefully and frequently. I am also an employer. I just make sure everyone follows very good sanitation and health rules! I make sure the employees who need to see doctors frequently have ample opportunities to do so. I am also inflicted with a couple of conditions which make it important for me to see my doctors on a fairly rigid schedule. Above all! Don't Discriminate! or allow any others to discriminate!

It is a tough balancing act protecting your employees, protecting your other employee's rights to privacy, and your obligations as an employer. I am listing a few websites to go to that can explain things better for you than I can in this limited space. http://www.hivatwork.org/index.htm http://www.entrepreneurship.org/Resources/Detail/Default.aspx?id=11152 http://www.thebody.com/content/art6911.html

ouch- tricky one. personally i'd have a quite word with this worker, don't say "do you have medical conditions?" just say you're concerned about some rumours which are going around and wondered if he knew about the hearsay- you're not directly asking him about it, so it's legal, but hopefully he'll tell you about it anyways. you can only become infected through saliva or blood, not skin, so aslong as they don't share cups or anything like that, they should be ok. we're in a world where you become critised of all sorts, it's ridiculas.... i actually fear speaking out against many things incase i'm accused of being racist, sexist, prejudice etc etc etc... ARGHHHHHHHHHHHHHH! xxxxxxxxx

both of these are transmitted through bodily fluids... as long as they don't share them then don't worry about it... like... don't be drinking their blood or anything

hep. b can be spread through sweat so maybe you should ask about his condition

Krystal L

you really are uneducated!! the only way they can catch it is by exchange of bodily fluids, so basically they ***** him and they will get it, they drink his bood they will get it!! etc!! you can still touch him, shake his hand and be fine. personally i hope the person in questions sues your assss for discrimination

You cannot get these diseases unless you have sexual contact or come into contact with his blood. It sounds like you are trying to stir up trouble. Stop before you lose your job.
