What are the rights of an employee?

What are an employee's rights about availability due to medical reasons?

  • I'm not sure about what my rights are as an employee who has a medical condition my employers are aware of and they are not respecting my availability despite my telling them, dealing with a management change over and giving the new manager the availability that I was hired with. They had a months warning and when the next months schedule came out I was still scheduled outside of my availability. I had an ER visit and was hospitalized because I could not take medication on time even. If any one could point me in the right direction so I can read up on what my rights are in this case, please help.

  • Answer:

Depends on the state laws and what company policies are.

An employee's right about availability due to medical is that he or she should be access programs like short term disability benefits or long term. If you are absent from work due to disability, your employers should organize for LTD benefits if they plan to suck you. For more advice, you should visit a lawyer.

In most cases they dont have to make alliwances for your medical issues unless you are legally disabled. Unless you are legally disabled and covered under the ADA your employer could even fire you for missing too much work.
