My bank account has been levied. What can I do?

Can a foreign bank account with branches in the US be levied by a US court order due to a personal lawsuit?

  • For example, a Singapore HSBC or Standard Chartered bank account.  Both banks are not US but do have branches there.  If a US citizen were sued (potentially by creditors) but not able to be served could a court order from the US actually place a levy on those accounts?  I'm not asking about tax/IRS levies here, just personal lawsuit.

  • Answer:

I think you are asking that if a default judgment issues from a US Court are those accounts at risk?   1.  If the accounts are in the US - Yes, regardless if these are foreign banks.   2. If the accounts are not in the US, the answer is maybe but the creditor will have an uphill struggle unless you, the account holder, are physically in the US and the court gets jurisdiction over you and threatens to hold you in contempt. This answer is not a substitute for professional legal advice....
