What are the rights of an employee?

What are my rights as an employee where I have been an employee for 9 weeks? <br><br><br>

  • I needed to go to the supply room last Sunday, asked the finance manager to unlock the room and when he did he grabbed me & starting kissing and hugging me. I told an employee that I felt comfortable discussing the matter with. The Office Mgr called me and I got two days off work with pay, also was able to leave early another day. The Office Mgr, General Manager, and Human Resources person had a quick meeting with me and had me put it in writing.

It sounds like your employer is doing everything right. They are protecting you while dealing with the finance manager. (Who is a pig.) Just keep a journal of everything that happened and list names dates and times in it. Did you get a copy of what you wrote down for them? If you didn't I don't know I would ask for it, but anything else you do need to ask for. I don't think I would sue if the company fires the guy. It will just make for a stressed work place, and can make it difficult to find a new job. I know it isn't fair, but that is the way it is. Now if they don't fire the guy, I would be looking for a lawyer.

That's just plain and simple sexual harassment. You did right discussing it with another employee. Do what those above me have suggested.

It doesn't matter if you have worked there nine weeks or nine minutes. What he did was sexual assault. I had something similar happen to me years ago by a superior at work, and I regret every single day of my life that I did nothing about it. You absolutely did the right thing, and you should not worry about any negative repercussions from it. You have documented what happened, and thus protected yourself. You have excellent grounds for a criminal case against this slimeball. You have also put management on notice that you are a person with morals.

What did you put in writing? Did you write what happened or sign that you would not say anything? Almost every workplace upon hire has a policy for sexual harassment that should protect you. Instead of giving you a couple days off they should be looking to moved the guy to another shift or department. You should not feel that you do not have safe working environment. That includes people talking about situation. Call the Labor Board to see what you can do about incident.

ALWAYS get a copy of ANYTHING you write out, or sign. No matter what, you are entitled to it. I agree with Filing a Sexual Harrassment Case. Find a Great a Attorney by checking with the State Bar and checking out if there has been any complaints against the Attorneys you want to talk to BEFORE you hire them. Don't ad to your trouble by hiring some HACK ATTORNEY. It also sounds like they knew this Finance PIG was capable of this, and have had issues with him doing it before. Just be sure you let the Attorney you hire know that & give them as much info that you can. Like the names, dates & times of all that happened. NEVER !!!! be alone with someone you don't know, no matter where you are. If you are a minor tell your parents. Be safe !

First You go to the District Attorneys office a file a sexual assault charge and they will call in a officer to take a Official report and then more and likely a arrest warrant will be issued and then if you work day shift you go on to work with a copy of the police report to show why you was late -- the company tried to apply a little butter on you to avoid a law suit .

Nine weeks, which means you most likely are on probation. This is sexual harassment however, be cautious because you are the new employee and sometimes companies will let a probationary employee go before letting management go. Does not mean it's right, yet you want to be aware of how some business deal with issues. Do not discuss this with any other employee, unless it's management and you have a witness. Documentation!
