Can i use my holiday entitlement as my notice period after my 9 months paid maternity leave?

  • I left for my maternity leave September 2011 and I took all my holiday entitlement for 2011 before I left. I am due to go back in July but I don't wish to return. Can I use my 2012 holiday entitlement as my notice period after my 9 months paid maternity leave?

    Hi, It depends if your work are paying you full pay whilst you are on maternity leave as if they are and you leave you will have to pay this back. Your best bet is talking to HR department. As they may not wish to give you holiday entitlement if you put in resignation. Lx

Yes you can, if your work are paying you statutory maternity pay you are still classed as working for them so in this case you will have earned holidays for when you were on maternity leave. You can take this when your 9 months runs out, you can also take up to a year off on maternity but the remaining three months will be not be paid leave. You should go into your work and talk to your boss about doing this, they may be able to say no if you haven't given them enough notice. I took 13 months maternity, 9 months paid leave 3 months none pay and 1 month holiday, I decided not to go back to work after this though. I didn't owe them the holiday pay as it was what I had accumulated while I was off on maternity.
