Can my employer withhold my final pay and vacation pay?

Can my employer hold my vacation pay until next year?

  • I've been working here for 5 years, and my employer has just informed me that we will not be able to pull from our vacation pay this year. We have been taking our vacation pay as it accumulates throughout the year (some of us for about 20 years now). However, now, he tells us "we're doing it differently this year", and that our vacation pay will accumulate for the following year. We will not be able to use our vacation pay for this year until January 1, 2012. Is this legal? If so, what is this called? I live in Ontario, Canada.

    Never heard of the practice of "pulling vacation pay". In most companies you are given a certain period of time for paid vacation - like 4 weeks - and you either take your vacation time during the year or lose it

Not sure if that is legal. But there are many companies that do this, there are also companies that do not pay for after hour work. Believe it or not, their employees still works butt hard. Not sure if there is anything you can do even if it's not legal. Ontario

In most companies, payment of vacation pay is a matter of company policy. Sometimes it's paid on a particular day every year, regardless if you take the vacation time or not. Sometimes, it can be drawn on as you have been doing in the past. All a question of company policy, which sometimes is guided by Union/management agreement and/or by industrywise agreements. If you company has decided to change this policy and applying this new policy to all employers, I think it's within legal guidelines.
