How does mono affect a person?

If a person hasn't paid taxes in 10 years, how will being appointed to the board of a non-profit affect this?

  • Considering the consequences of helping a person who has been caring for rescued horses set up a financially sustainable non-profit organization supported by donations and some internal revenue generation through horse riding lessons, pony rides, and horse-boarding. This person may have not paid their taxes for the past 10 years - so before we go down the road of contacting a Tax Lawyer, I wanted to know if that person being on the board of a non-profit will be subject to opening up that can of worms and reconciling back taxes immediately. Thanks

  • Answer:

The first question one should ask is why has this person not paid taxes in 10 years. Perhaps his income is below the filing requirement. If that is the case there is no problem. If he is a dead beat or tax protester that is another question. Why have such a person on the board. He is going to get the organization in the same tax troubles he has.

The organization will have to decide if it wants a person like that on the board or if it wants to insist that the person get right with the IRS before being appointed. IRS will only solicit filing of six years of delinquent returns, not ten.
