How can I have a BIR certificate of Tax Exemption?

Tax exemption from retail stores in Canada?

  • Hi, I have a small business and can apply for a tax exemption certificate (in Ontario). Will retail stores like Future Shop honour tax exemption certificates? I am looking to purchase an electronic in quantity and the total is going to be around $20,000. If they will accept it, I can save over $2500. The tax exemption certificate applies to re-sellers, but I’m not sure if Future Shop (or The Source, etc.) will accept it knowing that you will be re-selling. This product is currently only available at a few retail stores (no suppliers or wholesalers yet). Thanks!

  • Answer:

They should not charge you tax if you provide reseller certificate. At least in US, IRS comes and see that you sold it to reseller than they will not ask for tax on those sales.

The store cannot refuse to accept a tax exemption certificate, if you provide one. It is not their job to decide whether it is for resale or for company use (some items for company use are also exempt). Future Shop sells goods at a price. Unless they have some limit on the number of items purchased, they have no say in what you do with the product once you leave their store. In fact, if this is an advertised price, they are legally required to sell it to you at that price.
