There is a lien on my GST credits, how do I get it removed?

I have an old student loan that my tax refunds get taken for every year, they have never taken my GST checks before because I have a very low income and a disabled child, and this year, they said they will take it and when I log on to my account, it says they are taking it. How do I get the lien taken off? I need the money as I am getting three payments at once and have a lot of bills to pay with it. How do I get the lien taken off my GST and tax refund?

Wow. You seem to have hit the spam jackpot this morning. The only way to remove the lien is to negotiate with whoever it is that placed the lien in the first place, in this case, whichever student loan agency it is. They probably won't remove the lien without being paid off, and once they have your money, whatever the source, they don't give it back. There's no use in contacting GST or income tax. The only thing they can do is confirm amounts transferred, and confirm where the money eventually ended up. When the lien appears, they have no choice but to comply with it.

Now that they have started with a lien there is nothing you can do except pay off what is owing.

Call the student loan people, plead hardship, make a payment arrangement, and stick to it. Alternatively, call a trustee in bankruptcy and explore your options with them, such as filing a consumer proposal. Student loans under 7 years old aren't discharged by bankruptcy or a proposal, but collection action stops while you are protected by the Bankruptcy and Insolvency Act. But, they can still "set off" debts, so if the student loan is owed to the federal government, that wouldn't stop them keeping the GSTC. If you have a student loan that is outstanding to which you are neglecting payments, the government can and will seize any tax refund or GST credit you are expecting.
