Can I claim tax rebate for my brother?

  • I am an Australian Permanent Resident, residing in Australia. My brother came over in Nov 2008 to study. He is a full-time student in University and 21yrs old, residing with me. I pay for his rent, food and clothing etc. Am I eligible to claim tax rebate for the expenditure on him?

    You may be able to claim him as a dependant. According to the ATO a dependant can be "a student under 25 years old who is studying full time at school, college or university". It also states: "A dependant needs to be an Australian resident for tax purposes. For a spouse, student or child only, they will be treated as a resident if you have always lived in Australia or you came to live in Australia permanently, unless they have set up a permanent home outside Australia." Your brother might not be eligible for your to claim dependent rebate. First of all, he is not Australian Resident. Secondly I assume his main living source is from your overseas family, I think when he applied student visa, your parents will need to provide evidence that your family can afford his living expenses and tuition fees during his study. I think your family have paid for his tuition fees. You are not his sole resource to live on.
