With Australian tax, can you claim deductions on items if someone else's name is on the receipt/invoice?

In the Australian Tax system, you can claim certain deductions for your business. Can you claim deductions on items that you purchased under someone else's name? For example, John bought a computer, but his friend Sue picked it up and so she paid for it with her credit card, and her name was on the invoice. However John then transferred the money to Sue that he owed for the computer, and so now John wants to claim the computer as a deduction for his business (since he paid for the item, but his name isn't on the receipt) Is this possible? What proof would you need for this?

The name on the invoice is irrelevant. It simply shows that Sue has loaned/gifted the money to John (even if only for a couple of days). It doesn't determine the deductibility of depreciation on the asset. What will determine the deductibility is the ownership of the computer and the purpose for use. If there were ever an audit, it would be fairly easy to prove the arrangement - a chat with Sue and John regarding the matter. Even if Sue decided to gift the computer to John, this wouldn't affect the deductibility of depreciation on the computer. This would be aside from the fact that John would still be the owner of the computer and use it for business purposes.

Generally this is not acceptable. You might be able to claim it if you have proof of transfer of payment to Sue and a signed statement (perhaps a statutory declaration) to confirm the details of the purchase.

No. The only way I could imagine you'd be able to get around it, is if Sue wrote John an invoice & receipt for payments made to her by John.
