Can I claim a tax rebate?

If an income tax rebate takes months to be dealt with, can you claim compensation?

  • I put in a claim for an income tax rebate 2 months ago and expected a cheque within 2 weeks. There is no question that I am owed the money but the excuse I am constantly given is that they are upgrading their computer software and it will take another couple of weeks. Now it has been two months and I am getting angry. I am not a compensation-seeker but is there not something like that I can threaten them with to get them to pull their finger out? UK answers only please :)

    It is unlikely you would get compensation for this. You could try, make an official complaint, and ask for compensation. Usually that is only for cases in which serious official errors apply, which cause you to lose out financially. I don't think normal working practice delays come under this. Interest on repayments is only given where the overpayment is more than a year behind, eg. relating to periods before 05/04/08. But the interest rate paid was so low, I'm not sure if they bother any more. HMRC don't like official complaints or complaints to MPs. I think that will be your best options.

Sorry No. I had to wait 2 months for my rebate. You have no rights at all. It will come when they are ready.

The Inland Revenue will deal with everyone in their own time. However, they will pay interest on money owed to you from the date when it became due (i.e. the date when they were in receipt of a sum in excess of your liability), but you need to ask them to pay interest when you make your refund claim. They do not volunteer it.

Most tax offices have 11 weeks post on hand. Everyne wanted a smaller civil service and that's what you got!
