How to get a letter from Inland Revenue that I could work as self-employed carer?

  • I registered myself 4 years ago to be self-employed housekeeper,but I am working as personal care assistant for disable man,he does not pay tax for me,also I don't because i received letter from IR that it is unlikely that one could be self-employed carer. what will happen now?

    The chances are that HMRC will rule that you are employed, and disabled man will be held financially responsible for the tax and NIC he hasn't deducted from you, plus penalties for non-compliance. Neither employer nor employee can decide employment status, that is laid down by strict criteria (look at http://www.hmrc.gov.uk , go into individuals more topics, then into toolbar and employment status indicator). The chances are that this will come under the domestic system for PAYE (or "Q" scheme), with simplified forms being used.

Your employer cannot just decide to disengage frm his responsibilities as an employer. If you are working at someone's premises, at the hours they decide and at a rate of pay set by them, then you are an employee. Your employer has to pay your NIC, sick pay, holiday pay, etc and provide insurance. By deciding he doesnt want to employ you, yoou are being deprived of these rights. So, this employer needs to decide whether to engage with the system or go without a carer.

I have done lots of different care work but it has always been either by contract (full time), as bank staff who are used as and when, and as agency staff who also can be used as and when. From an accounts point of view I think I would prefer to stay in this arrangement rather than go self-employed, with all its hassles. Hm. Will have to think about the pro's and con's.
