  • I am staying with my sister who is a student (not paying rent), under the law should i pay council tax? When she informed the council of her student status, the council transferred the council tax payment to me. please advise me

  • Answer:

Yes you should be paying council tax if you are classed as a permanent resident - the only way you wouldn't be was if you could prove that you had a permanent home elsewhere and are paying council tax there. As they have your name and the fact you are living there I'm guessing it's a bit more long-term, and so you will be liable for the council tax with a 25% single person discount (your sister doesn't count as a student). It doesn't matter who owns or rents the place, it goes on who is calling it home ans what their status is. Keep in mind that this is one of the few debts where if you are caught trying to sneak out of it, they can send you to prison, so don't try to swindle this one.

The owner of the house is usually the one who pays. In rented accommodation the person responsible will be named in the rental contract. If you are staying as a guest I wouldn't have thought you'd be liable. I should go and ask the Citizens Advice Bureau.

You need to show your council tax bill from your permanent address as previously said. They can't hold you responsible for this unless you are not being honest here. Why would your name even be associated at that address ?

I'm guessing by 'staying' with your sister you mean you are living there but not paying rent. If your sister is renting the property and is a student she would be disregarded and you would be liable, you would get a 25% discount disregard. If your sister owns the property and you are staying with her, even though she is a student, she would become the liable person to pay - not you. However, she would get the 25% discount disregard because she is a student. If you are just visiting, then you shouldn't be on the bill at all. As previously mentioned, provide the council with proof you're living elsewhere.
