How my divorce is affect my child tax credit?

My husband is working part time (16 hrs). I am not working. We have 2 children and i am a full time carer of my 10 yrs old girl. My husband is receiving working tax credit on his account and I am receiving child tax credit (£572 each month with disability award) in my account. This is not my daughters Disability Living Allowance (DLA). I also receiving child benefit in my account. Last 4 years we have got a family problem but still living in same roof (separate rooms). Recently he applied to divorce but has not informed to the HM Revenue. After the divorce we will be living in same roof (separate room) because we both love our children.I am thinking to inform them and make a separate claim. Is it affect my child tax credit? Does anyone know, divorced parent living in same roof can make a joint claim? OR Should i inform my divorce now to HM Revenue?

Answer:
If you separate the claim you will lose the working tax credit part as you do not meet the criteria as your not employed for 16 plus hours pw. You may see an increase in the CTC payment but depends on the joint claim and current income. Tax Credits law define a couple as l;iving together under the same roof as a couple. However you can make a separate claim even if living under the same roof if your intentions are to be permently separated. As you can see it gets complicated. Ring HMRC and ask what is best for you

you need tor ing and tell them whats happening because your claim will no longer be joint if your divorced so it will effect your income

tax credits are based on total household income so if you are still lving in the same house I don't see how your benefits will be affected
