How do I claim import tax back on gifts?
-
My parents recently forked out for some christmas presents for myself, but being parents, they're terrified of using their bank card online. So I purchased my christmas gifts using my card from a website in japan and had them shipped over here, and my parents gave me the cash back, I woke up today expecting a delivery only to find royal mail are holding them due to unpaid customs charges. How do the rules on gifts work and can I claim whatever (probably extortionate) charges they hit me with back? The delivery consists of a single package containing four model kits, costing £35, £37, £40, and £120 respectively, with a £19 delivery charge.

Answer:
Presumably your parents are also in the UK too? If so, then this doesn't qualify as a gift even if you'd paid for it the 'right' way. To qualify as a gift they would have to be outside of the EU. "Gifts ordered over the internet - UK tax and duty still due Ordering and paying for goods over the internet to be sent to someone other than you, doesn't count as a gift. The recipient will be liable to UK duty and tax."

Other answers
That's not how it works. The person in Japan sold them to you/your parents. He didn't send them as a gift because they weren't gifts from him. Whether it's you or your parents, one of you owes the customs charge. You can sweet talk your parents and say oops, I didn't know I would owe more, but you can't get it back from the government.
Quick Answers
Sorry, but is an import tax from the Government. Not reclaimable! If you don't pay the customs duty - you don't get the goods!
