Can the IRS "Make you sell your home?"?

  • I am looking for someone who has factual information rather than opinion if you please. After exhausting all efforts with the IRS to accept an offer incompromise and or some sort of a payment plan.......can they........MAKE YOU sell your home to satisfy the debt? I know they "Make" you feel you have to but is there some directive, chapter or verse I can cite them that says "Hey...you cannot make me sell my home". Thanks Duffasbutt

When confronted by an IRS agent always ask to see their ID and driver's license. Also ask to see the LAW that requires you to file and pay an income tax. The IRS is not listed in the list of Governnmental Agencies.They are empowered by the Treasury Department. (They are a glorified collection agency) Don't let them bully you. Refuse to sell your house. Insist that you can pay 'X' amount of dollars each month and that is what you will do.A case in Tennessee determined that wages are not taxable income and the IRS cannot tax a man's right to work for wages.(see cite listed as my source) Technically you don't owe them a cent.

Have you consulted a lawyer yet? I am not sure about the feds, but the state revenue dept can not only force the sale of your home, but also tie up your banking, savings, and stock accounts. Good luck, but I would certainly be looking for legal help.

Yes they can if it's to settle debt you have with them. It's better if you sell it yourself instead of letting the government seize it. If YOU don't sell it they WILL seize your property and they WILL auction it, which could cause you to still owe the bank you have your mortgage through.

you need an attorney that can work out payments for you. without working out payments they can do lots to you. bankruptcy is even a better option. you can pay the irs instead of your creditors and keep your home.
