Driver's license is from Indiana, but I live/work in Illinois. Do I have to file with Indiana too?
-
I have lived and worked in Illinois since 2002, but my driver's license is still from Indiana. I was told that since my license was from Indiana I was considered a resident of that state and, therefore, would have to file for Indiana too. I have not worked in Indiana though.

This depends. Do you have ANY, ANY money, income from Indiana? Interest from a bank account? Rental Income? W-2? If none of you tax papers say, State withholding and have the name Indiana next to it, then you do not have to file with Indiana. YOu only have to file with the state for which you made income. Now, IF by chance your employer paid Indiana state wages on you(which most BIG companies will) then you do have to file. So, look at the state name next to your W-2, if it says Illinois, then you only have to file with that state. Also, it is up to you to tell your employer, that you are a resident of Illinois, so that they only withhold Illinois state taxes on you. IF you are a student only living there during school, you might have a problem with this, because the state will consider you Not a resident, because they assume you are only staying their during your time at their school. Good Luck There are so many contingencies to state law. Try to give as much detail as possible. I hope I could answer your question. YOu may want to file an Indiana return anyway, because it will most likely have zeros on it anyway.

If you live in illinois. You have to have a illinois License. You actually have 10 days from moving to illinois to get it switched. If you get pulled over they can issuse a ticket for not transfering or informing something like that. Also they can suspend your license in Indian if they find out you dont live there. It's only like 10 bucks i think maybe less to transfer and all you need is a piece of mail to take to the dmv with ya

Why don't you just get an Illinois license?

Yes its a ticket if they catch you.

Your driver's license is your official residence - so either get an Illinois d/l or file in Indiana. BTW, you are committing fraud if you have car insurance and list your home in Indiana - so if you're doing it to get a break there, if you have a claim the insurance company can choose not to honor that claim and sue you.

This logic is totally bogus. Just because you have a drivers license from another state does not make you a resident of that state. The drivers license does not determine where you live. Where you live determines where you live. Usually, most states require a new resident to turn in their out-of-state license and obtain a new one from the state in which they live within 6 months. To fail to do so is breaking the law.

I think that your question is regarding your income tax returns. From the information you provided you reside in Illinois and work there also. If that is correct you will only need to file a federal return and one in Illinois. Your driver's license has nothing to do with where you file a tax return. But you may wish to get an Illinois driver's license as you could get a traffic ticket if you were stopped.
you shuld be able to just get a pass, but if you just go there and not live there then you dont need another liscense for it!

No. You don't have to file with IN. but you should get your license switched to IL. before you get caught(i e ticket). It will cost you a lot more then than now.
