When I get my tax my tax return and the credit I get for my daughter will my soon to be ex wife get half or no?

If the daughter is living with the mother then why are you claiming her? If your daughter did not live in your home for more than 6 months of the year, you can't receive any earned income credit for her or file as head of household. IF the mother gives you a signed 8332 form, this will allow you to claim the child tax credit only. But if she is the custodial parent, and she doesn't give you that form, then you won't be able to claim your child. But to answer your question no, they wouldn't send her half of your refund if you were eligible to claim the child. Unless of course you were behind on child support and and an offset was issued. Then they would take the amount you owe, and send it to her.

If you are still married she is entitle to half. If you filed as single head of household she might use your daughter as dependent if she files. If you filed as married but you are legally separated you could give her the % of the amount she earn from the total gross. Lets say you earned $70000 and she earned $30000 and you get back $1000 then she gets $300 and you keep $700...

it doesn't matter where she lives at , if you contribute more than or atleast 51% of her support you should be able to claim her per irs. Be careful though that you both have an understanding on who claims who because this year the irs annoced that when an issue like this accures they will give the credit to the one with the highest AGI FOR The yr.

Did she give you written permission to claim your daughter, or do you have a court order saying you can? If not, you probably don't have the legal right to claim her, her mom does.
