How to find out if i owe back taxes?

I want to file my taxes with my new husband, but i'm afraid he may owe back taxes. How can I find out online?

  • I would like to take advantage of filing "married filing jointly." But my husband may not have filed a return about 5 years ago. We know that they kept his last refund... So we are wondering, where we could find out if we filed together, if they would keep some or all of the refund. Also, he will be a 1099 this year, how does this affect the refund?

  • Answer:

    He can find out by calling the IRS, 800-829-1040. There is no where online to find that type of information. If he does owe, you can still file together if you file a form 8379. The 8379 will prevent the IRS from taking your portion of the refund. If he has a 1099, he will have to pay a self employment tax, but it is not possible to tell you what impact there will be on the refund without additional information.

You could go to the i.r.s., web site and ask a question. Also your local tax office could help,(google,"find local tax office"). My husband & i have had to file an, "injured spouse," form and that saved us from loosing any money. We filed jointly.

You have no legal right to any information about his prior tax filings. HE can request the information, but YOU can't. I believe you can make the request through the IRS website, but you can't actually receive the records on-line. If you file a joint return, there is a form to claim 'innocent spouse' status. This would protect 'your' share of the return, as determined by the IRS. It sounds as if you qualify.

if he owes back taxes from before you'll were married then file joint but attach a innocent spouse claim form 8857 to you'll return to protect your half of refund from being offset.
