Do I get Unemployment Benefits if I Quit?

  • Okay so here is the Deal, My boss use to have an office in Vernon NJ, I live in Bushkill PA. My boss had many contracts around the Vernon NJ area going into PA and I would do work for him at a customer site 5 days a week located around Newton NJ, When I was hired this is where I was told I would be 5 days a week. A year later the contract expired and they decided not to renew so my boss relocated me to Warwick NY on a contract he had there, (keep in mind our central office is still in Vernon NJ so my paycheck says I work there) now that contract is running out and they will not renew because my boss wont come down in price for my services. So here is the conflict although my boss has other work for me to do he says it will be farther out. He has since then Relocated the Central office to Mahwah NJ and closed the Vernon Office. Mahwah NJ from Bushkill is a little over 2 hours long My boss says he doesnt want to lay me off but its too bad he had to close the Vernon office and lost all his contracts in northeastern NJ now he says I will have to work out of the Mahwah Office in NJ. My question is can I quit and still get unemployment. He refuses to compensate me for mileage and will Cover No traveling expenses he says he doesnt care either i deal with it or quit, I dont know what to do if i quit can i get unemployment I have worked there for 2 years and I hear NJ is pro employee I need to know ASAP please he says I will have to use my car to go to the Mahwah office everyday and drive around customer locations in southern NJ.i cannot afford it !!!!!! this is not what I was hired to do when I was hired I was told I would be in Newton and work from the Vernon Office now that has all changed what can I do :(. (sorry for beeing so long)

Since Mahway to Warwick is just 26 miles, you would most likely not be eligible for unemployment if you quit. They'll look at how much FARTHER you'd have to travel due to the relocation, not where you live.

You have to have a very good reason to quit that the state will accept and still get unemployment benefits,otherwise your just S.O.L.! Check with your state dept. of labor to find out. You may be able to post a question on their website. If you keep accurate mileage records,you may be able to write most of your travel expenses off on your taxes ( including most repairs,meals,lodging). Check with the IRS about deductible business expenses. If it doesn't work out for you,get for another job before you quit,jobs are getting harder to find even though Obama says the economy is improving.

If you have a mutual agreement, you can collect. For instance, you can asked to be laid off so you can collect. He may agree to do that to help you out. Also, you can collect if he gives you a choice to either move out of your range or quit. You have good reason to quit and that would constitute a mutual agreement. However, for the mutual agreement to work the employer would have to approve your request for unemployment benefits. I do have one question, though. Were you a 1099 contractor or w-2? If you were a w-2 contractor, then you can apply for benefits. If you were a 1099, forget it. You would be considered self employed and you would be denied benefits.

To remove the disqualification you must return to work for at least four (4) weeks, earn at least six (6) times your WBR, and then become unemployed again through no fault of your own." If the state determines that the requirement to work so far from home is "good cause" for quitting, then none of the previous paragraph applies, and you may receive unemployment benefits.
