How to file state taxes while W-2 from two states (different employer?

Is it right that i paid state taxes againt my entire years income to two diff states?

  • I work in Illinois but am a resident of Wisconsin. On my W2 I paid state taxes to both the states. I know they have a reprocity agreement between the states but my employer is positive that they are correct in me paying both states. Furthermore, I never filled out a W4 for both Wi and IL. Help please!! I need proof to show my employer they are wrong! I've already provided them with information right from the WI Dept of Revenue but that apparently isn't enough. What steps can I take next? Who can I speak to?

  • Answer:

if you are are resident of Wi by reason of home ownership, car, voter registration, bank accounts and other ties, Wi is your state to file you would file non resident ILL on the income but since probably all your income is ILL, you likely are not exempt from paying if the two states have a credit between the two states for paying income taxes on duplicate income that is probably all you can do for IRS purposes your tax home is where you work
