IRS tax professionals?

If I report a preparer/company for tax fraud, will I find out if/when they're reprimanded for it?

  • Ok, so long story short.. I went somewhere to have my taxes done this year (just got married last year, took out my 401K.. lot of stuff going on that I don't normally deal with, so I didn't want to f them up.. well, I should've taken that chance). Tax lady put my husband as SINGLE and myself as Head of Household. Went back to her today to try to get our money back (just received our refunds today) and she still INSISTS what she did was okay and legal.. Insists she would never do that to anybody, showed me HER OWN personal tax returns on her computer, as well as her husbands and says she files theirs the same way every year (single, him, head of household with dependents). She printed out forms from the IRS website, highlighting certain things, justifying what she did. She even called her boss and her boss agreed with her. I've talked to the IRS THREE times since they were filed on the 13th, asked Yahoo answers, and every other person I've talked to has said this is NOT allowed.. I know I'm right. Anyway, point is, I'm reporting her, and want to know how long it takes for the IRS to take action. I know they're extremely busy, but I am in such a huge bind with this.. no way I can amend it myself, after talking with two VERY helpful and sweet TurboTax professionals, I realized it really would be almost impossible to fix this mistake. State taxes are messed up, federal are messed up, and both my husband and I have to fix it somehow.. I don't even know how to start, there are so many complications in this matter. I have to now go to the army post we live near (we are an army family) to try to have them help amend our returns, as well as get our money back for what we wasted at this tax place. I tried to get it back today, but how do you argue with someone who insists they're right? So again, when I report her to the IRS, how long will it take for them to take action? I know they're extremely busy, backed up, etc. But I would be so angry if this person got away.. I believe she's been there for a few years, but you never know.. I can't believe she does this on a normal basis.. swears she's never been audited or anything.. I recorded our conversation on my voice recorder just in case I needed evidence.. it's just crazy. And will I be able to find out if something happens (consequences)? Will the IRS contact me when I report her, in order to get more information? I'm willingly giving them my information and WANT them to contact me.. I don't care to remain anonymous. It's absolute hell trying to fix this. I just hope they catch her.. Please help! Thanks :)

    First sorry about your experience with a so called professional. Things will get better next year when the new rules are fully in place. Now to answer your question it depends on how you report them? If you pick up the phone and call probably nothing at all will happen. If you file the correct forms this will ensure some type of investigation. If you actually go into the local IRS office and tell them that you want to talk to someone in Criminal Investigation (CI) you will be able to talk to someone that is actually going to investigate your complaint. If you do the latter ask him for a referral to a Taxpayer Advocate to help you fix your problem (more than likely they can do it locally). Whatever you do, DO NOT go the free help on base to solve this problem...this is out of their league. This is what I do for a living correcting others mistakes, from beginners to CPA's to lawyers. Quick Answer's is wrong they will not automatically zero out your husbands return, if you file an amended return. I just finished an audit that took 10 months and 4 levels of auditors and the end result was they held the spouse responsible for the return she filed, but credited the husband for the amended return. If you talk to someone at the local office in the CI and are not comfortable with the answers. I would suggest talking to an experienced Enrolled Agent Hope this helps!. Edit: If this goes past April 17th make sure you ask them to abate the penalties. In your case it should be a give me for them to do so.

Short story no. Long story, you have to fix your tax return and must do so before 4/17. To fix this, amend your HOH return into MFJ. (The IRS will automatically zero out his single return). Put BOTH refunds on line 17. Pay back what you owe before 4/17.

Sounds more like total incompetence than fraud, but in either case, this bunch should NOT be preparing taxes. Situations like this is what's driving the upcoming competency testing for paid preparers, and it's good that it will exist. Report this to the IRS, including everything you said here plus the agency name and address and the preparer's name. No you won't be contacted. You need as you know to amend your own returns by the 4/17 deadline. If you get refunds from your original filing, don't spend it until you know how much you'll have to pay back. Note: Russ is partially right, on what to do and what will happen, but is wrong on his assessment of Quick Answers response about the amendment which is correct. Amending your HOH return into a joint return WILL wipe out your husband's original filing. And this should NOT be out of the league of the preparers on base.

and these people have PTIN's? the only way possible one of you could file hoh was if you had split by June 30 of the year and not a single overnite thru Dec. 31, the one with the children could file hoh and claim the children from your scenario it is not evident that you and your husband can file as they indicated, and your reporting to IRS will probably not be reported back to you, you will know they have been caught when they are longer in business and to set your accounts right you need to amend your returns I agree this is going to be a complicated procedure but you can prepare a dummy return filing jointly and use that to indicate the changes you will need to make on your 1040X's
