Are taxes higher in PA or OH?

Does my employer have to take out PA taxes if....?

  • I live in PA and work in NJ? My dad, a tax accountant says my employer s required by law to take out the taxes of the state I live in, not the state I work in, but my employer says they are only required to take out NJ taxes and don't have anything to do with PA. I know there are forms I can fill out to apply my NJ taxes to PA, but if they would just take out PA to begin with I wouldn't end up owing money. So is there a law about this?

    Your father is an Accountant in PA, every state has different laws. If it is a small company they may actually be unable to withold PA taxes from your check. You also may not want them to stop withholding NJ tax. Depending on NJ tax law you may also have to pay them.
