How can i get my childs last name changed to mine?

  • Answer:

In most states a probate or family type court is responsible for name changes. You would have to apply to the court which usually would have authority to change the name if it believes it is not against the interests of the child or the public. A parent may contest the name change and the judge may take that parent's objection into consideration in his/her ruling. Depending on the age of the child, he/she may also have input into the court's decision. Checking on -line for your state's probate or similar type court rules would be helpful as well as a call to the clerk of the court itself.

I don't think you can - I think he/she has to when he/she turns 18.

Take him to court. I'm sure they'd do it if he's really being that way.

I think you can go to a lawyer, but go to a lawyer and talk to them and they will tell you what you can do.

How old is the child? Has he been court ordered to pay child support? Does he have a job? Why did you give the child his name in the first place? What I imagine has happened is you thought it would keep you two together. You broke up and now you want to take it out on him. You restrict visits, you are difficult. Now you want to get 'back' at him by changing the childs name. You don't have ordered support but expect him to pay.

you can legally change a childs name by deed poll, u can fill out the form online and there is a small fee but the documents are sent quite quickly
